1. Scope of application

These Terms and Conditions (T&C) of Temporex Lifestyle GmbH, Hinsbecker Löh 10, 45257 Essen, Germany (hereinafter the “Seller”) apply to all contracts concluded by consumers within the meaning of Section 13 of the German Civil Code (BGB) via the Seller’s online shop.

Sales are made exclusively to consumers. Orders placed by business customers within the meaning of Section 14 BGB, for commercial purposes or resale, are excluded. The Seller reserves the right to reject or cancel such orders.

Translations of these T&C into other languages are provided for convenience only. The legally binding version is exclusively the German version.

2. Conclusion of contract; ordering process

The presentation of products in the online shop does not constitute a legally binding offer. Images and descriptions may vary within reasonable limits and shall only be deemed a defect if the product’s suitability is significantly impaired.

Orders can only be placed via the online shop. Orders by post, fax or email are not accepted.

Before submitting an order, the customer receives an order overview allowing verification and correction of all details. By clicking the order button, the customer submits a binding offer to conclude a purchase contract.

The contract is concluded at the earliest of the following events:

• dispatch or order confirmation,
• charging of the selected payment method (e.g. PayPal, Klarna), or
• delivery of the goods.

The Seller may accept the offer within five days. If no acceptance is made within this period, the offer is deemed rejected.

The contract text is stored by the Seller. The T&C, cancellation policy and order data are sent to the customer by email. The contract language is German.

2a. Orders to Switzerland

For deliveries to Switzerland, the purchase contract is concluded between the customer and MeinEinkauf AG, St. Gallen, Switzerland (CHE-331.561.017 VAT).

MeinEinkauf AG handles customs clearance, invoicing and delivery within Switzerland. These services are included in the purchase price and any applicable shipping costs.

For transparency, the customer is informed that MeinEinkauf GmbH, Konstanz, Germany (DE285677365), is involved in the supply chain. This does not result in any additional costs for the customer.

3. Prices and payment terms

All prices are final prices including statutory VAT. Any shipping costs are shown during the ordering process.

For deliveries to non-EU countries (except the United Kingdom), additional customs duties, taxes or fees may apply and are borne by the customer.

The payment methods offered during checkout (e.g. credit card, PayPal, Klarna) are available. The terms of the respective payment providers also apply.

4. Retention of title

The goods remain the property of the Seller until full payment has been made.

5. Delivery and shipping

Delivery is made to the address provided by the customer. For PayPal payments, the address stored with PayPal may be decisive.

Additional costs caused by incorrect address details or failed delivery are borne by the customer if attributable to them.

Self-collection is excluded.

The delivery countries, delivery times, shipping costs and any published Incoterms in the “Shipping & Delivery” policy apply. This policy forms part of the contract.

The Seller is entitled to ship orders in multiple parcels.

6. Pre-orders and delivery times

The online shop may offer products that are not yet available at the time of ordering (pre-orders or backorders).

Any indicated availability or delivery dates are non-binding estimates only.

Shipping takes place as soon as the product is available. In case of significant delay, the customer will be informed.

7. Right of withdrawal and returns policy

Consumers have a statutory 14-day right of withdrawal. Details are governed exclusively by the “Returns & Refunds (Withdrawal)” policy.

8. Return costs and return labels

Details regarding return costs and procedures are governed by the applicable returns policy.

9. Liability for defects and warranty

Statutory provisions apply.

A three-year warranty may be granted for manufacturing defects where indicated.

10. Provision of repair services

10.1 Performance of repair services

The provider may have repair services carried out wholly or partly by qualified third parties (subcontractors). The exclusive partner is:

10.2 Shipping and transport

If shipping is required for repair, it is carried out at the provider’s cost and risk.

10.3 Warranty and liability

The provider is liable for subcontractor actions as for its own vicarious agents under Section 278 BGB.

11. Liability

Unlimited liability for intent and gross negligence, as well as injury to life, body or health.

In cases of slight negligence, liability is limited to essential contractual obligations and foreseeable damages.

12. Promotional vouchers

Subject to specified conditions. No cash redemption.

13. Gift vouchers

Valid for three years, not redeemable for cash.

14. Order quantities, resale, pricing errors

The Seller may refuse suspicious orders or those intended for resale.

15. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

16. Jurisdiction

Statutory jurisdiction rules apply.

17. Consumer dispute resolution

The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

18. Severability clause

If any provision is invalid, the remaining provisions remain unaffected.
